ACKNOWLEDGMENT OF RISK AND DELIVERY & RETURN POLICY

In consideration of being allowed to participate in water sports, specifically including surfing, stand up paddle boarding, and/or being provided with water sport recreational property or services, for myself and any minor children for whom I am parent, legal guardian or otherwise responsible, and for my/our heirs, personal representatives or assigns. 

1.  ACKNOWLEDGMENT OF RISK

ASSUMPTION OF RISK AND RESPONSIBILITY         

I agree to assume responsibility for all the risks of the activities mentioned above and not mentioned above, or property (even those risk arising out of the negligence of the releasee named above/below). I assume full responsibility for myself and my minor children and/or the product(s) for whom I am responsible for bodily injury, accident, illness, paralysis, death, loss of personal property, and expenses thereof as a result of any accident which may occur while I/we participate in the activity (even if caused, in whole or in part, by the negligence of the releasee named below). I agree to use all appropriate safety equipment while performing including but not limited to activities mentioned above. 

RELEASE

I hereby release Surf Fin Rental Company L.L.C., (the lessee), its principles, directors, officers, agents, employees, and volunteers, their insurers and each and every land owner, municipal and governmental agency upon whose property an activity is conducted or based from (owner) and their insurers, if any (collectively “releases”) from any and all injury or damage, including death) to be named releasee and other persons as a result of my/our participation in the activity.  Even if caused in whole or in part by the negligence of the releasee named above/below. 

RESPONSIBILITY FOR EQUIPMENT AND SECURITY DEPOSIT

The lessor (renter/customer) assumes full responsibility for all equipment (any product offered, surf fins and/or all accessories included in the rental) in lease from the time the equipment leaves the lessor's property or location until both lessee and lessor acknowledge the satisfactory return of property. The lessor agrees to protect all equipment from loss, theft or damage using sound judgement.

A security deposit of each product's retail value will be shown but not charged during checkout. This security deposit is per product and is automatically set up to show the product’s full retail value plus $30 to cover taxes, shipping and fees associated with purchasing a new set of fins. In the event that property is damaged, lost, or stolen, lessee assumes full responsibility and agrees to pay lessor for full retail replacement value plus $30 on damaged or destroyed equipment, or the product’s security deposit mentioned above. The lessor agrees to provide purchase receipts as proof of value.   

2. DELIVERY & RETURN POLICY

Surf Fin Rental Company L.L.C. (SFRco) only provides mailing delivery on all online bookings. The bookings by default have a 5 day packing period before and after a rental period to allow SFRco time to assess damage, pack, ship and allow for delivery time to the lessee. 

Confirmation of delivery will be verified by the provided tracking number via mailing service. The lessee assumes full responsibility once the product(s) have shipped. No refunds will be given for mis-delivered packages. If the package was deemed lost by the mailing service, SFRco will provide a replacement shipped to the lessee’s door at no cost to the lessee (there will be a delay in replacement fins delivered to the lessee as SFRco may have to purchase a new set from a 3rd party). If this option does not work for the lessee, another fin set can be selected and will be overnighted at no cost to the lessee.

On the last day of rental period the package must be packed with all rental product(s) including but not limited to, set(s) of fins, the fin bag(s) the fins came in, taped securely shut, return label stuck over original label, and dropped off to the mailing service before the mailing service closes the same day, including Sunday. If packages do not have an active tracking within 24hrs of the last day of rental period, a daily rate of $25 will be charged until tracking is active. 

CANCELLATION POLICY

Surf Fin Rental Company L.L.C. (SFRco) allows cancellations on rental bookings up to 7 days prior to the rental date (delivery date). If the order is cancelled in full or partially, at least 7 days out, you will receive 88% of your payment back on your card within 7 / 10 business days. SFRco retains 12% to cover sales tax and card processing payments. If cancellation is within 7 days of the rental date no refund will be issued and the lessee will be responsible for returning the order, if the order was already shipped to SFRco at no cost to SFRco (if the order was shipped there will be a return label already in the package). If SFRco is forced to cancel your order due to loss or damage of rental equipment during the prior rental week(s), you will receive a full refund and SFRco will work with you to either get a replacement set of fins or a different selection of fins to you in a timely manner. If SFRco is forced to cancel your order due to your mistake in booking (e.g. the wrong week, the wrong set of fins, or others not mentioned, SFRco will retain 12% to cover expenses explained above and you will receive 88% of your payment back if the booking error is at least 7 days prior to your rental date (delivery date).
